Virginia police officers, judges and prosecutors all think that Field Sobriety Tests are reliable indicators of a driver’s intoxication or impairment. Well, they are not reliable at all!!! Some police officers are even unaware that some people should not be tested because they are overweight, physically impaired, or may be on medication that affects their balance and coordination. More than a decade ago, a Clemson University study demonstrated why Virginia police officers, prosecutors, and judges may err when relying on a suspect’s performance on Field Sobriety Tests to justify the arrest for DUI/DWI. That study demonstrated that 14 veteran South Carolina police officers could identify as “sober” ONLY 3 out of 21 people performing the FSTs on videotape — though all 21 were stone-cold sober at the time. The results of this study casts doubt on the claimed reliability these tests have in establishing probable cause to arrest for DUI / DWI.
